{"id":47960,"date":"2024-08-06T13:23:31","date_gmt":"2024-08-06T11:23:31","guid":{"rendered":"https:\/\/fare.lu\/?page_id=47960"},"modified":"2024-08-06T13:48:33","modified_gmt":"2024-08-06T11:48:33","slug":"announcement-of-rental-lease-revision","status":"publish","type":"page","link":"https:\/\/fare.lu\/fr\/announcement-of-rental-lease-revision\/","title":{"rendered":"Annonce de la r\u00e9vision du bail \u00e0 loyer"},"content":{"rendered":"<p>[vc_row css=\u00a0\u00bb.vc_custom_1722860984080{padding-bottom: 90px !important;}\u00a0\u00bb][vc_column][vc_single_image image=\u00a0\u00bb47967&Prime; img_size=\u00a0\u00bbfull\u00a0\u00bb][vc_column_text]Chers membres,<\/p>\n<p>Le 10 juillet 2024, la Chambre des d\u00e9put\u00e9s a vot\u00e9 le projet de loi n\u00b07642 portant modification :<\/p>\n<p>1. de la loi modifi\u00e9e du 21 septembre 2006 sur le bail \u00e0 usage d&rsquo;habitation;<\/p>\n<p>2. de l&rsquo;article 1714 du Code civil.<\/p>\n<p>La nouvelle loi entrera en vigueur ce jeudi, 1er ao\u00fbt 2024.<\/p>\n<p>Pour rappel, le 15 avril 2024, le Conseil de gouvernement avait approuv\u00e9 les amendements gouvernementaux au projet de loi n\u00b07642 portant modification de la loi modifi\u00e9e du 21 septembre 2006 sur le bail \u00e0 usage d\u2019habitation. La nouvelle loi du 23 juillet 2024 \u201cBail \u00e0 loyer\u201d a \u00e9t\u00e9 publi\u00e9e au Journal officiel en date du 25 juillet 2024.<\/p>\n<p>Pour finaliser ce projet de loi dans les meilleurs d\u00e9lais, et face \u00e0 la forte contestation de la r\u00e9forme du plafond des loyers, le Conseil a d\u00e9cid\u00e9 de supprimer ce volet du projet de loi. Les autres aspects importants, largement approuv\u00e9s par les milieux concern\u00e9s, sont maintenus.<\/p>\n<p>Voici les principaux points de la r\u00e9vision du bail \u00e0 loyer :<\/p>\n<h3>1. Colocation<\/h3>\n<p>Le projet de loi introduit des dispositions sp\u00e9cifiques \u00e0 la colocation.<br \/>\nUn contrat de colocation unique sera \u00e9tabli entre les locataires et le bailleur, accompagn\u00e9 d&rsquo;un pacte de colocation.<br \/>\nLes colocataires pourront se lib\u00e9rer de leurs obligations avant le terme du bail avec un pr\u00e9avis de 3 mois et devront trouver un rempla\u00e7ant.<\/p>\n<h3>2. Obligation d\u2019un bail \u00e9crit et respect du plafond l\u00e9gal du loyer<\/h3>\n<p>Tous les contrats de bail \u00e0 usage d\u2019habitation devront \u00eatre r\u00e9dig\u00e9s par \u00e9crit et inclure certaines mentions obligatoires.<br \/>\nLa conformit\u00e9 du loyer avec le plafond l\u00e9gal devra \u00eatre stipul\u00e9e dans chaque contrat de bail futur.<\/p>\n<h3>3. Pr\u00e9cision des modalit\u00e9s relatives au plafond du loyer<\/h3>\n<p>Les dispositions relatives \u00e0 la r\u00e9forme du plafond des loyers seront r\u00e9vis\u00e9es pour trouver un \u00e9quilibre entre les besoins des locataires et des propri\u00e9taires.<br \/>\nLe montant des loyers pay\u00e9s dans le cadre d&rsquo;une location ne pourra pas exc\u00e9der 5% du capital investi dans le logement.<br \/>\nUn suppl\u00e9ment de loyer pourra \u00eatre demand\u00e9 pour les logements meubl\u00e9s.<br \/>\nLa r\u00e8gle des tiers annuels sera remplac\u00e9e par une limite biennale de 10%.<\/p>\n<h3>4. Abolition de la notion de logements de luxe<\/h3>\n<p>La notion de \u00ab logement de luxe \u00bb sera supprim\u00e9e, garantissant l&rsquo;application du plafond du loyer pour tous les types de logement.<\/p>\n<h3>5. Partage des frais d\u2019agence immobili\u00e8re<\/h3>\n<p>Les frais de commission des agences immobili\u00e8res seront partag\u00e9s \u00e9quitablement (50\/50) entre le bailleur et le locataire.<\/p>\n<h3>6.
